We collect information from the following sources:
Personal Information You Provide Us. We collect information you choose to provide when using our Network, including when you contact us, or request services. You may decide whether to provide information, but we may need certain details to respond to your request.
Information Collected Automatically. When you use our Network, we and our service providers may automatically collect information about your device and how you use the Site. This may include online identifiers, browser information, and the pages you visit. We may use cookies and similar technologies to collect this information.
These technologies may include:
Pixels. Pixels, sometimes called web beacons, can show whether someone opened an email, visited a page, or clicked on content. They help us understand how our website and communications are performing.
Cookies. Cookies are small pieces of data that your browser stores on your computer or mobile device. We use them to understand how you use the Network, remember your settings, personalize your experience, support online advertising, and maintain security. You can adjust some automatic collection through your browser or device settings, although doing so may affect website features. Each browser is different; consult its Help menu or visit https://allaboutcookies.org/ for more information.
Session Replay Technologies. Third-party session replay software can record a replay of how visitors interact with the Site, including clicks, mouse movements, scrolling, touches, typing, and other activity. We use these replays to troubleshoot website issues, understand how visitors use the Site, and identify possible improvements.
Chat Technologies. Our website may offer chat features that let you contact us or receive responses through an automated assistant. If you use a chat feature, the vendors supporting it and other third parties may access identifiers and information about your online activity, as described above. They may also monitor or record chat interactions for the purposes explained in this Privacy Policy or disclosed when you use the feature.
Software Development Kits (SDKs). SDKs are third-party code used with an App. They can help us analyze App use, connect social media features, add functionality, and support online advertising. SDKs may allow third parties to collect information directly through the App.
Information from Third Parties. We may also receive personal information from:
Publicly available materials, including public records and information on social media.
Referral sources, such as members of our referral network, website submissions, and other referral sources.
Our business partners, such as third-party data providers, advertising partners, and service providers.
Individuals or entities involved in our clients’ legal matters, such as doctors, other parties, and other individuals that you may direct to provide us with information.
We may combine information from these sources with information we collect directly from you or through your use of the Network.
Use of Personal Information
We may use personal information for the purposes described below and for other purposes explained when we collect it.
Personal information to provide our services.
Review an inquiry or request for a free evaluation and determine what assistance may be appropriate;
Provide services, information, and resources;
Respond to your inquiries and communicate with you, including by telephone or text using automated technology, which may include prerecorded messages;
Maintain, diagnose issues with, and improve our website and related services;
Understand your interests, personalize your Network experience, and provide information about our services that may be relevant to you;
Answer service questions, resolve reported problems, and assess how well we respond; and
Protect account access through measures such as verification codes and recognition of previously used devices.
For Direct Marketing. We may use your personal information to send you newsletters, updates, marketing communications, and other information that may interest you. You may opt-out of our marketing communications as described in the “Your Rights and Choices” section below.
Research and Development. We use information to understand how people use our Network, review statistics and trends, resolve technical issues, and improve or develop services and features. We may create aggregated, de-identified, or otherwise anonymous information by removing details that identify individuals. We may use and disclose this anonymous information to third parties for lawful business purposes, including improving the Network and promoting our business.
Targeted Advertising. We, our service providers, and our advertising partners may collect and use certain personal information for targeted advertising, sometimes called “cross-context behavioral advertising” under state privacy laws. Advertising and social media companies may help us identify potential customers and display ads on our Network and other websites or services. These companies may use cookies and similar technologies to gather device and online activity information over time across sites and services, including interactions with our emails, and use it to select relevant ads. We may also provide hashed customer lists so partners can show ads to those customers or similar users. See “Advertising Choices” under “Your Rights and Choices” to learn about options for limiting targeted advertising.
Legal Compliance, Fraud Prevention, and Safety. We may use personal information to:
apply and enforce applicable terms, policies, and agreements;
meet legal requirements and respond to lawful government or court processes;
to protect our, your, or others’ rights, privacy, safety, or property (including by making and defending legal claims);
to maintain the security and integrity of our business, the Network, users, our third party business partners and service providers, our databases and other technology assets;
audit our internal processes for compliance with legal and contractual requirements and internal policies; and
identify, prevent, and investigate misuse, fraud, identity theft, unauthorized activity, and other potentially unlawful or harmful conduct.
Artificial Intelligence Tools. We may use services or applications supported by artificial intelligence (AI) or machine learning in our operations. These tools may assist with marketing and advertising, developing or improving features, supporting our work for clients, managing matters, or responding to questions and requests. Depending on how you interact with us or an AI-supported feature, your personal information may be processed to generate relevant results or improve the models we use. Unless we provide a separate privacy notice for a particular service, the personal information involved remains subject to this Privacy Policy.
Disclosure of Personal Information
In addition to disclosures explained elsewhere in this Privacy Policy or at the time information is collected, we may disclose personal information to the following categories of recipients:
Service Providers. Binder & Binder may disclose personal information to companies that perform services for us, including website hosting, mail and SMS delivery, analytics, event support, and information technology services. Their access is limited to the information necessary to perform their functions on our behalf and for no other purpose. We do not share mobile information with third parties for marketing or promotional purposes. Mobile information may, however, be shared with service providers that deliver texting services for us or when required by law.
Advertising Partners. We may disclose personal information to advertising or joint-marketing partners for the purposes set out in this Privacy Policy, including targeted advertising, or as otherwise described when we collect the information. We do not share mobile information with third parties for marketing or promotional purposes; mobile information may be provided to texting service providers or disclosed when required by law.
Other Users and the Public. If you submit feedback, reviews, or other content through our services, we may display your name or other identifying details with that content. We cannot control how other users or third parties use information you choose to make publicly available.
Professional Advisors. In the course of obtaining professional services, we may share pertinent information with our accountants, auditors, insurance providers, banks, attorneys, and other advisors.
Affiliates and Related Companies. We may disclose personal information to companies that currently control, are controlled by, or are under common control with Binder & Binder, or that become affiliated with us in the future, for the purposes described in this Privacy Policy.
At Your Direction or With Consent. We may disclose information when you direct us to do so, when you have agreed to a particular disclosure, or when consent is otherwise required under applicable law.
Other Law Firms or Lawyers. At your direction or with your permission, Binder & Binder may disclose personal information to other law firms or attorneys when we jointly represent you, refer a matter or potential matter, or as otherwise required for representation. When information is provided as part of an attorney-client relationship, we take appropriate precautions to preserve its confidentiality and any applicable attorney-client privilege.
Authorities, Law Enforcement, and Private Parties. We may disclose personal information when needed to meet legal or regulatory obligations, assist investigations, enforce agreements, protect rights or property, protect others’ safety, or prevent crime. Where relevant to a matter we handle, information may also be disclosed to courts, police, or law enforcement agencies.
Your Rights and Choices
Opt-Out of Marketing Communications. You may request to stop receiving promotional communications by emailing contact@binderandbinder.com or writing to us at the address under “Contact Us.” Our electronic marketing messages may also include an unsubscribe option. Removing you from marketing lists may take up to 10 calendar days, and you may receive messages during that period. You can also contact us if your information changes or you believe information we hold is inaccurate.
Text Messages. Binder & Binder or our service providers may send SMS messages for customer service, account matters, or marketing. To stop future texts, reply STOP. We may send one message confirming your request. Message and data rates may apply. You may also ask to stop marketing texts by emailing contact@binderandbinder.com and including your mobile number.
Cookies. Most browsers allow you to delete cookies or block them from being stored. Check your browser settings for instructions. Blocking cookies may affect how parts of our website work. More information is available at https://allaboutcookies.org/.
Advertising Choices. Some advertising partners belong to the Network Advertising Initiative (NAI) or follow the Digital Advertising Alliance (DAA) principles. You can learn about participating companies and opt out of certain targeted advertising at https://www.networkadvertising.org/ and https://optout.aboutads.info/. You may also block third-party cookies through browser settings, privacy tools, or ad blockers, and adjust advertising identifier settings on mobile devices. Some partners offer separate controls, including Google (https://adssettings.google.com/authenticated) and Facebook (https://www.facebook.com/about/ads). These choices may need to be set separately for each browser or device. You may still see ads after opting out, including ads from companies not covered by these options.
Do Not Track. Some web browsers transmit a “Do Not Track” (DNT) signal to websites. Our website does not currently respond to or alter its practices when it receives these signals. However, separate privacy laws may require us to recognize other automated opt-out signals, such as Global Privacy Control (GPC), as explained in the state-specific disclosure sections below.
Declining to Provide Information. We need to collect personal information to provide certain services. If you do not provide the information requested, we may not be able to provide those services.
Online Analytics
We may use outside analytics services, such as Google Analytics, SEMrush, Funnel, and Hotjar, to understand how visitors use our Network and identify areas for improvement. These services may collect information about your device, browser, and use of the Site.
For details about Google's practices, visit the Google Partner Policy Page. The Google Analytics opt-out browser add-on is available through the Google Analytics Opt-out Tool.
For more information on SEMrush's tracking controls and data management, please review the SEMrush Privacy Policy.
To learn more about how Funnel handles visitor analytics and privacy choices, see the Funnel Privacy and Cookie Notice.
For details regarding Hotjar's session tracking, behavioral mapping, and individual user opt-out instructions, you can visit the Hotjar Data Privacy Hub.
Information Security
Binder & Binder take commercially reasonable measures to secure and protect the personal information we collect. Nevertheless, no security system is impenetrable, and we cannot guarantee the absolute security of your personal information. Moreover, we are not responsible for the security of information you transmit to us over networks we do not control, including the Internet and wireless networks.
Linked Websites
This Privacy Policy does not apply to third-party websites or social media features that may be accessed through links that we provide for your convenience and information. Accessing those links will cause you to leave Binder and Binder’s website and may result in the collection of information about you by a third party. We do not control, endorse, or make any representations about those third-party websites or their privacy practices, which may differ from ours. We encourage you to review the privacy policy of any website you interact with before allowing the collection and use of your information.
Using the Network from Outside the United States
Binder & Binder is headquartered in the United States, and our affiliates or service providers may operate in the United States or elsewhere. Your information may be transferred to, stored, or processed in the United States, where our servers and central database are located, or in other countries outside the United States. Privacy laws in those places may offer different protections. By using the Network, you understand these transfers and, where permitted by law, consent to transfers to our U.S. facilities and the third parties described in this Privacy Policy.
Children’s Privacy
We do not knowingly solicit or collect personal information online from children under the age of 18. Please contact us as provided below in the “Contact Us” section if you believe we may have collected such information.
Additional Notice to Residents of Applicable U.S. States
Residents of certain states have additional privacy rights. This section applies where a state privacy law covers your information, including, where applicable, California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia. For this section, “personal information” has the meaning given under the applicable law and does not include information that law exempts.
Collection and Use of Personal Information
The sections above explain:
The categories of personal information we collect or have collected during the preceding 12 months, along with the categories of sources, under “Types of Personal Information We Collect”;
Why we process the information for operational and commercial activities (see “Use of Personal Information”); and
The groups of recipients that may receive the information (see “Disclosure of Personal Information”).
Personal Information We Disclose, “Sell,” “Share” or Use for “Targeted Advertising”
The categories listed under “Types of Personal Information We Collect” may have been disclosed, or may be disclosed, to recipients described under “Disclosure of Personal Information” during the 12 months preceding this Privacy Policy’s Last Updated date for the business purposes described here or when we collect the information.
During the 12 months before this Privacy Policy’s Last Updated date, we may have “sold,” “shared” for cross-context behavioral advertising, or used for “targeted advertising,” as those terms are defined under applicable state law, the following categories of personal information with advertising partners: individual identifiers and demographic information (such as name, email address, IP address, device ID, other online identifiers, gender, age, and marital status), and internet or network activity information. Such disclosures may involve monetary or other valuable consideration under applicable law. See “Exercising Your Privacy Rights” to request an opt-out where available.
We do not knowingly sell, share, or use for targeted advertising the personal information of people we know are under 18. Where we collect sensitive personal information as defined under applicable law, we use or disclose it only for permitted purposes, including providing requested services, managing a matter, detecting security incidents, preventing fraud, and maintaining service quality. We do not collect or use sensitive information to infer personal characteristics.
Your Privacy Rights
Your rights depend on your state of residence and the law that applies. Some rights may not apply to all information or may be subject to exceptions. Where available, they may include:
Right to Know. The right to confirm whether we are processing personal information about you and, in some cases, to obtain certain details about our collection and use of your personal information, including, where applicable:
The types of personal information collected;
The sources used to obtain that information;
The business or commercial purposes for which the personal information was collected, or used for targeted advertising;
The categories of personal information disclosed to third parties (if any), and the recipients to whom this personal information were disclosed; and
The categories of personal information shared for cross-context behavioral advertising or targeted advertising purposes (if any), and the categories of recipients to whom the personal information was disclosed for these purposes.
Right to Access & Portability. The right to obtain access to the personal information we have collected about you and, where required by law, the right to obtain a copy of the personal information in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another entity without hindrance.
Correction. You may have the right to ask us to correct inaccurate personal information, considering the nature of the information and why we use it.
Deletion. You may have the right to request deletion of personal information, subject to legal exceptions that allow or require us to keep it.
Opting Out of Sales. If our sharing of information counts as a “sale” under the law that applies to you, you may have the right to opt out. Some states define a sale to include sharing information in exchange for something of value other than money.
Opting Out of Targeted Advertising. You may have the right to stop the use or sharing of your personal information for certain targeted advertising activities.
Right to Revoke Consent or Limit the Use of Sensitive Data. Where we rely on consent to process sensitive personal information, you may withdraw that consent. Where state law provides this right, if sensitive personal information is used to infer characteristics about you, you may request that we limit its use or disclosure to purposes permitted by that law.
Right to Non-Discrimination. The right not to receive retaliatory or discriminatory treatment for exercising any of the rights described above. However, please note that if the exercise of the rights described above limits our ability to process personal information (such as in the case of a deletion request), we may no longer be able to provide you our services or engage with you in the same manner.
Exercising Your Privacy Rights
To exercise an available privacy right, email contact@binderandbinder.com or call 1-800-424-6337. Where permitted by law, an authorized agent may submit a request for you.
To opt out of the sale or sharing of personal information through cookies or other tracking technologies used for targeted or cross-context behavioral advertising, you can click on the cookie settings icon located in the lower-left corner of our Site to adjust your preferences. Where required by law, the Website also automatically recognizes and honors Global Privacy Control (GPC) signals. If you visit our Site with an enabled GPC signal, we will treat that signal as a valid request to opt out of the sale or sharing of data on that browser. Please note that if you change devices or browsers, or clear cookies holding your preferences, you may need to make your selections again or rebroadcast the GPC signal.
Please provide the following details so we can review your request:
Which Right You Want to Exercise. Tell us what you are asking us to do and, where relevant, which information your request concerns.
Authorized Agents. If you are an authorized agent acting on behalf of another consumer, please clearly indicate this fact and your authority to act on such consumer’s behalf. We may require the consumer’s proof of identification, the authorized agent’s proof of identification, and any other information that we may request in order to verify your request, including evidence of valid permission to act on the consumer’s behalf.
Help Us Verify Your Identity. Provide us with information to verify your identity. Please note that if we cannot initially verify your identity and confirm you are a resident of a state that offers the relevant right(s), we may request additional information to complete the verification process. Any personal information you disclose to us for purposes of verifying your identity will solely be used for the purpose of verification.
How to Contact You. Give us an email or mailing address for our response. If you contact us by email, we will normally respond to that address unless you request otherwise.
You will not have to pay a fee to access your personal information (or to exercise any of the other rights). However, we may charge a reasonable fee or decline to comply with your request if your request is clearly unfounded, repetitive, or excessive.
We try to respond to valid requests within 45 days, or within another period required by applicable law. If a request is complex or involves multiple inquiries, we may need more time. We will notify you of any delay and may provide updates on our progress.
Appealing Privacy Rights Decisions
If your state allows you to appeal a decision about a privacy request, email contact@binderandbinder.com with “Privacy Request Appeal” in the subject line. Please explain which decision you would like us to reconsider. Depending on your state, you may also contact your state Attorney General.
Additional Notice to California Residents (Shine the Light)
For California residents, we treat requests to opt out of “sales” or “sharing” as requests under California’s “Shine the Light” law to stop sharing personal information covered by that law with third parties for their direct marketing purposes.
Additional Notice to Nevada Residents
Nevada Revised Statutes Chapter 603A allows Nevada residents to opt-out of the “sale” of certain types of personal information. Subject to several exceptions, Nevada law defines “sale” to mean the exchange of certain types of personal information for monetary consideration to another person. If you are a Nevada resident who wishes to exercise your “sale” opt-out rights, you may submit a request to us using the contact information listed at the end of this Privacy Policy.
De-identified Information
We may at times receive, or process personal information to create, de-identified data that can no longer reasonably be used to infer information about, or otherwise be linked to, a particular individual or household. Where we maintain de-identified data, we will maintain and use the data in de-identified form and not attempt to re-identify the data except as required or permitted by law.
Retention of Personal Information
We will only keep your personal information for as long as necessary to fulfill the purposes for which it was collected and processed, including for the purposes of satisfying any legal, regulatory, accounting, or reporting requirements. To determine the appropriate retention period for your personal information, we will consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process it (and whether we can achieve those purposes through other means), and the applicable legal requirements. In some circumstances we may anonymize your personal information so that it can no longer be associated with you, in which case it is no longer personal information.
Changes to This Privacy Policy
We may revise this Privacy Policy to reflect changes in our practices or applicable law. Revisions take effect when posted on our Network. The Last Updated date below indicates the most recent revision. If you continue to use the Network or communicate with us electronically after changes are posted, you acknowledge those changes.
